I am a 65-year-old retired employee. I have deposited more than `10 lakh in fixed deposit (FD). The interest earned on the FD is being credited monthly/quarterly in my savings bank account with the same bank. Since I am not an income-tax assessee as per my yearly income, I have submitted the required Form No. 15 to the bank seeking exemption from tax deduction at source. Inspite of this, the bank is deducting the tax at source but refunding back the deducted amount later on. When I sought clarification, an official told me that as per a new rule, the bank from this FY has to deduct the tax at source on deposits of more than `10 lakh but will refund it later on.

A (1C) provides that senior citizens can file the declarations referred above irrespective of the gross amount received. Therefore, the deduction of tax on interest by the banker even after receiving the declaration from a senior citizen is not correct.

Moreover, certain responsibilities are attached on the deductor towards deduction of tax. Once deduction is made, the amount so deducted shall be remitted to the credit of the central government: ■ In respect of tax deduction made on the amount paid or credited to the account of the payee, one week from the last day of the month when such deduction was made; ■ If credit entry has been passed in the books of the payer on the last day of the financial year based on accrual system of accounting, two months from the expiration of such last day of the financial year.

Please clarify if such deduction is allowed for contribution to PPF made in names of children, who are earning adults and married too.

Puducherry: Imagine spending pots of money on arms,but not having the wherewithal to learn how to use them.Thats exactly what the Puducherry administration has done,drawing censure from the Comptroller and Auditor-General.
Only 20% of the 2,500-odd police personnel in the Union territory could be trained in handling weapons procured in 2008,a report by the CAG has revealed.
The Puducherry police department,which procured modern weapons like self-loading rifles (SLR),sten guns,.303 rifles and AK45 rifles,among others,at a cost of 1 crore in 2008-09,could not train all its police personnel due to non-availability of a shooting range in the territory.The police department had to rely on neighbouring states for training,the report said.
Training in handling pistols and revolvers was given to just 174 officers and upper subordinates and 288 lower subordinates during 2008-09 at a shooting range in Tamil Nadu.Similarly,annual firing practice in 7.62 mm SLR (bolt/action) and 0.303 rifles was given to 43 lower subordinates in 2007.To sum up,only 20% of 2,579 police personnel had been trained in handling weapons.
The department has now proposed to give live training in modern weapons to all police personnel in a phased manner.The CAG also pulled up the department for ignoring the direction of the Directorate of Coordination (police wireless),New Delhi,to consult the Electronic Corporation of India,Bangalore,while procuring wireless communication devices.
Puducherry police had procured 258 walkie-talkies and 50 VHF sets without scramblers at a cost of 33.41 lakh and distributed them to various wings.The equipment without scramblers could put the secrecy of police communications at stake,the report said.
The CAG also noticed delay in setting up a forensic science laboratory in Puducherry,despite the Union government allocating 2 crore for the facility.The department failed to include the proposal in its annual action plan and in the absence of the facility,samples were being sent to laboratories in Hyderabad and Chennai leading to delay in investigations.
The report also noted that the department did not maintain the Common Integrated Police Application (CIPA),a Central project to computerise police stations.A check of records revealed that information regarding inquiry,investigation and disposal of cases was not available in police stations.Similarly,data regarding crimes and criminals were not maintained as envisaged in the CIPA.

City schools unannounced shutdown kicks off debate

Chennai: The unannounced closure of the Kaligi Ranganathan Montford Matriculation School in Perambur last week over an alleged scuffle involving some parents and the institutions correspondent,has sparked a debate on the powers of private schools.
A day after the correspondent was allegedly assaulted by a couple of parents following an argument over a bid to form an association to demand the implementation of the government-fixed fees,the school was closed and a black badge protest was held on the premises in which correspondents of a few other private schools too participated.
While a section of private schools feel that the managements have a right to protest the alleged assault,two organisations,which have been supporting the governments move to rationalise school fee structure have questioned the move and petitioned school education minister Thangam Thennarasu seeking action against private schools.
In their common representations,State Platform for Common School System general secretary Prince Gajendrababu and Federation of Tamil Nadu Students-Parents Welfare Associations president S Arumainathan said private school managements cannot take law into their hands.
Only principals have the powers to declare a holiday for a school and correspondents have no role to play inside the institution during school hours.In this case,the government must probe if the Montford schools principal had sought permission from the directorate of matriculation school or the district education officer to declare a closure, asked Gajendrababu.According to him,the incident reflects an attempt by private school managements to gang up against the move to rationalise fee structure.
Meanwhile,PTA of Kaligi Ranganathan Montford Matriculation School has decided to stand by the schools decisions.

Thiruporur (Kancheepuram): Several residents of Thiruporur and Thandalam at a meeting on Sunday called for the elderly adhinam (hereditary trustee) of the 17th century Murugan temple in Thiruporur,43 km from Chennai,to be replaced with a younger person.The residents,part of the group that runs the temple along with the HR & CE (Hindu Religious and Charitable Endowments ) Department,will on Monday send a copy of the four resolutions passed to the Coimbatore-based chief adhinam of the Saivite mutt that has several temples,including the Thiruporur temple,under its fold.
The meeting,held on the temple premises,was attended by more than 300 villagers and devotees.The meeting also resolved to empower the chief adhinam to appoint a new adhinam;construct an arts & science college on an 18-acre plot in Thiruporur belonging to the Kandaswamy temple,also managed by the mutt;and,finally,take over the entire functioning of the temple.The present adhinam,Chidambara Sivagnana Swamigal,is 94 years old.He is physically weak and unable to take sound decisions relating to the temples affairs.So,we want a new and young adhinam, K Sivaraman,an advocate who led the meeting,told The Times Of India.Chidambara Sivagnana Swamigal,who has been at the Chettinad Hospital in Kelambakkam since November 12,is the 14th adhinam of the Murugan temple.According to residents,the adhinam was refusing to step down.Recently,we took up the issue to him personally but he is reluctant, said a source close to him.Sundays meeting comes in the backdrop of allegations against Chidambara Sivagnana Swamigal that he was trying to sell land belonging to the Kandaswamy temple to private persons.On October 7,an attempt was made to kidnap the adhinam to stop him from appearing before a court in Chengalpet.That day,he was to appear in court to explain that he was not involved in selling properties of the temples managed by the mutt, said a source close to him.On October 14,HR&CE commissioner P R Shampath appointed assistant commissioner Ashok Kumar as administrator and Balasubramaniam as executive officer.The day-to-day functioning of the temple was also brought under the HR&CE Department.madhavan.d@timesgroup.com

Second nikah on TV: Bhopal court issues notice to channel

Bhopal: A local court has issued a notice to Colors TV CEO for showing indecency and hurting Muslim sentiments by staging the second nikah of actors Sara Khan and Ali Merchant as part of the Bigg Boss reality show.
The court issued the notice and asked the CEO to appear before it or submit a reply through a lawyer on November 19 after admitting local Samajwadi Party leader Shamsul Hasans petition against the show.If the channel didnt file a reply and the CEO didnt appear before the court,an ex-parte verdict would be pronounced, the notice said.
Hasan argued that the channel hurt Muslim sentiments by organising the nikah of the two,who had already tied the knot.Islam has its rules for a second marriage between a man and a woman.It doesnt permit repeated marriages between the same individuals, said Hasan.Hasan said the channel had ridiculed the religion and every Muslim is pained by what was shown. 
Hasan also accused the chan nel of promoting obscenity Nikah is a serious institution ac cording to Islamic law.Its not a concept for earning money and boosting TRPs, Hasan said.
The second marriage of a man and a woman already wedded and not divorced is unacceptable in Islam, he added.

Kochi/Ahmedabad: Gujarat chief minister Narendra Modi arrived at Kochi on S at u rd ay night by a special aircraft on a two-day private visit to Kerala.Soon after arrival at the naval airport,Modi called on former Supreme Court judge V R Krishna Iyer and held a brief meeting.Justice Iyer headed the Concerned Citizens Tribunal (CCT) which investigated the 2002 post-Godhra riots.
It was before this panel,which also comprised former Justice (retd) Hosbet Suresh and Justice (retd) PB Sawant,that slain ex-minister of state for home Haren Pandya testified against Modi in 2002.
Justice Iyer praised Modi for being a good administrator and called him a statesman after the meeting.Modi is in Kerala to attend the marriage of the daughter of principal secretary to chief minister K Kailasnathan,to be held at Thrissur on Sunday.
Sources in the CMs office said that Justice Iyer had sent a message to Modi to meet him in the wedding,to which Modi suggested that he would meet the judge at his home in Kochi.
Pandya that told the CCT on May 13,2002 about how Modi had held a meeting of top bureaucrats,police officers and ministers on February 27,2002,where he had said that there would be justice for Godhra and riots broke out the next day.Pandya had spoken,on the condition that they would not name him in the report.

78 tribal girls run away from Orissa hostel

Berhampur: Seventy-eight girls ran away from Shankarakhola kanyashram,a state government-run school for tribals,in Orissas Kandhamal district.They were found by policemen who gave them shelter.
Late Thursday night,the girls were found loitering on the streets by some policemen of Tikabali police station,about 8km from their school.The cops gave them shelter for the night and also informed the hostel about the girls.
Student of classes VIII and IX,the girls fled because they were unhappy with the food served at the hostel.They were given a breakfast of chuda,instead of their afternoon rice meal,police said.So,they ran awayand tried to go back home.
The kanyashram,run by Orissas Scheduled Caste (SC) and Scheduled Tribe (ST) welfare department,has 420 girls.Inspector-in-charge of Tikabali PS Pradipta Panigrahi said the students returned to the hostel after their headmaster and hostel superintendent came to fetch them from the police station on Friday.TNN

Documents Point To Involvement Of CM,His Sons In Wrongful Allotments

Bangalore: BJP has been demanding telecom minister A Rajas scalp for alleged misdeeds in 2G spectrum allotment.But in Karnataka,skeletons are tumbling out of the scam-scarred B S Yeddyurappa governments cupboard.
In the latest incident the CM allotted land to his sons company.In the first of the three cases TOI has documents detailing the transactions land in a prime industrial hub of Bangalore was allotted to the CMs son a fortnight after floating a company.
In the first case,Fluid Power Technologies (P) Ltd,with a registered office at Peenya Industrial Area Stage III,was incorporated on May 18,2007.Yeddyurappas sons BY Vijayendra and BY Raghavendra were among the six directors appointed the same day.Of the eight shareholders,Vijayendra,Raghavendra and their another firm,Davalagiri Property Developers Pvt Ltd,held major stakes.Raghavendra had 5.45 lakh shares of Rs 10 each;Vijayendra 6.45 lakh shares;and Davalagiri 9.5 lakh shares with Raghavendra,Vijayendra and R N Sohan Kumar,son-in-law of Yeddyurappa,as directors.
On June 2,2007,the Karnataka Industrial Areas Development Board (KIADB) allotted 2 acres of land at Jigani I Phase,Bangalore,to Fluid Power Technologies.Possession of the property was taken on June 15,2009,after required procedures.
In the second case,as deputy CM,B S Yeddyurappa ordered action against a person for encroaching upon a Bangalore Development Authority-acquired land.But after becoming the CM he ordered denotification of the land in favour of the same person.
The BDA acquired 33 guntas of land 40 guntas equal 1 acre at Nagashettyhalli,Bangalore North taluk,for RMV Extension II Stage through a final notification on August 2,1978.On June 26,1984,the BDA decided to allot 21 guntas to NIT Society.The agency transferred the land in 1988 in favor of NTI Housing Co-operative Society Ltd.A certain G Selvakumar staked claim to the remaining 14,432 sq ft of land saying he had purchased the land in 1990.The issue reached the court.
On April 10,2006,acting on the complaint by party MLA Anil H Lad,Yeddyurappa wrote to the BDA commissioner seeking legal action against Selvakumar who had created false records.On August 23,2006,the 27th additional city civil judge,Bangalore,dismissed the petition of Selvakumar.
On May 28,2009,Selvakumar wrote to Yeddyurappa (then CM) asking him to denotify the land.CMs deputy secretary H R Mahadev wrote to the urban development department principal secretary seeking the file.The CM gave his nod.On January 13,2010,the government denotified a site at Nagashettyhalli in favour of Selvakumar.
In the third case,Yeddyurappa allotted a BDA site measuring 50x80 feet to his son Raghavendra on July 18,2009,at Nagashettyhalli,RMV II Stage,in violation of rules.
Though he owned two residential plots,Raghavendra took possession of the Nagashettyhalli site in violation of BDA rules which allow possession of land only by those who have no other property in its area.In the declaration before the EC in 2009,Raghavendra,MP from Shimoga,did not disclose these properties.On July 12,2004,Raghavendra had purchased a land from Manyata Promoters Pvt Ltd at Manyata Residency.
On April 21,2006,he had bought 20 guntas (21,580 sq ft) of land at Rachenahalli from S N Krishnaiah Setty.On November 3,2008,to favour his son,the CM had denotified this land acquired for Arkavathy Layout.Later,this agricultural land was converted to a residence.

An RTI petitioner in the city has filed a criminal complaint against an assistant commissioner of Corporation of Chennai for allegedly furnishing wrong information under the Right to Information Act.

In his complaint lodged with R-6 Kumaran Nagar police station on November 9, 2010, I. Senkol, a resident of Jaffarkhanpet, accused the assistant commissioner of zone-IX of Chennai Corporation of furnishing

wrong information in response to his RTI petition.

Mr Senkol had sought details like the length and width of Munusamy Street in Jaffarkhanpet and the amount of maintenance work done to maintain the street in the past few years.

He also asked the civic body if the street had been encroached.

He complained that a portion of the street had been encroached by a private party for over two years and civic officials were guarding the encroachers by ‘purposefully’ providing wrong information even without doing field verification.

In fact, Mr Senkol said, he

received information for his RTI petition nearly a year after he applied on December 19, 2008.

Worse, he obtained the information only after moving the State Information Commission and it directed the Corporation Appellate Authority, who treated the direction as an appeal, to reply to the RTI petition.

Assuring Mr Senkol that the issue would be looked into, a senior corporation official said the information had been furnished last year and a new assistant commissioner assumed office less than two months ago.

Confirming the receipt of the complaint, Kumaran Nagar inspector (crime) Subramaniam told Deccan Chronicle that the police had approached legal experts of the department to ascertain whether criminal action could be taken in such cases.

It may be noted that the appellate authority of the corporation, in his reply, had advised the petitioner to approach the state information commissioner if he was not satisfied with the reply.

An advocate has approached the Madras high court seeking that the state government be directed to register a case under section 302 (murder) of the IPC against the Coimbatore police commissioner and RS Puram police station inspector Annadurai for their “involvement” in the encounter killing of Mohanakrishnan, the prime accused in the rape and murder of schoolgirl Muskan Jain, 10, and the slaying of her seven-year-old brother Rithik.

The public interest litigation filed by P. Pugalenthi,

n the director of Prisoners f Rights Forum, is likely to r come up for hearing on November 15.
According to petitioner , when he learnt of the alleged encounter death of Mohanakrishnan through media reports, he lodged a complaint with the government and the DGP, seeking to register a case under section 302 of the IPC against the police officers involved.

“Whether the killing of Mohanakrishnan amounted to murder or culpable homicide is a matter for trial,” Mr Pugalenthi said. “When a citizen is killed by the police, the state is under constitutional obligation to register a case against the police officers concerned under section 302 of IPC.

The failure of the state to register a case would be violative of Article 14 and

21 of the Constitution."

He said the government had in a letter dated August 8, 2007 directed senior police officials to adhere to the guidelines of the National Human Rights Commission relating to police encounters.

"The NHRC guidelines state that whenever a complaint is made against police officers in a cognisable case of culpable homicide, an FIR to this effect must be registered under appropriate sections of the IPC," Mr Pugalenthi added.

However, in the present case, no case was registered against the police personnel concerned, he noted.

Not many takers for Centres additional foodgrains release

New Delhi: The release of additional foodgrains at highly subsidised rates under the public distribution system by the Centre,after being singed by the Supreme Courts give it free instead of wasting it remark,had very few takers,the UPA government informed the apex court on Thursday.
The ministry of consumer affairs,food and public distribution,in an affidavit before the SC,said it had made an additional ad hoc release of 25 lakh tonnes of foodgrains in September taking the total additional release up to October 30 to 86.72 lakh tonnes.
The affidavit presented before a Bench of Justices Dalveer Bhandari and Deepak Verma by Attorney General G E Vahanvati said: However,the lifting of foodgrains against the additional allocations as reported by Food Corporation of India (FCI) as on November 3 has been extremely low at 25%. 
This means,the intention of the SC to put pressure on the Centre to release additional foodgrains,overflowing in its granaries,so that it reached the poor and hungry,has virtually lost its purpose.
While complaining against the mismanaged and poorly stored foodgrains causing wastage and preventing the needy from getting food,petitioner Peoples Union for Civil Liberties through Colin Gonsalves had told the court that the Centre had not taken any step to lend an ear to the recommendation of the Sonia Gandhi-headed National Advisory Council for providing subsidised foodgrains to everyone in 150 poorest districts of India.The affidavit,which was personally vetted by food minister Sharad Pawar,stated: The recommendations of the NAC have since been received in the government and it is submitted that the NAC has not given any recommendation for special coverage of the 150 poorest districts. 
The Bench saddled Vahanvati with more queries related to better enumeration of BPL population and providing food to the poor families on the basis of the number of heads rather than counting the family as one unit for allocation of 35 kg of foodgrain per month.It also asked the government whether it would be possible to put a stop to issuance of subsidised PDS ration to those families which had an annual income of more than Rs 5 lakhs.It fixed November 29 for further hearing on the matter.

Bangalore: As heads of taint-hit leaders have rolled that of Ashok Chavan and Suresh Kalmadi on a single day murmurs are already sounding of what the BJP is doing in its backyard.Enough dust was raised recently over the scams surrounding the Yeddyurappa government,particularly over denotification of land to favour his family and his lieutenants.
Another instance of the CMs large-heartedness has come to light.Flouting norms,he has denotified two pieces of land measuring 25,604 sq ft acquired 32 years and 22 years ago by the Bangalore Development Authority (BDA) to help home and transport minister R Ashoka.
In all,14 guntas at survey number 10/11F and 9.73 guntas on survey number 10/1 at Lottegollahalli in Bangalore north taluk were denotified on December 31,2009.At the market value of Rs 6,000 per sq ft,the properties are worth about Rs 15.36 crore.Records show that he got it for Rs 44.77 lakh.
Documents with TOI show that the denotification has been done much against the advice of the urban development department principal secretary,who states that acquired lands where 16/2 notification has been issued cannot be denotified.Moreover,though it was under the possession of the BDA,Ashoka had purchased the lands from the erstwhile owners.The Karnataka Land (Restriction on Transfer) Act 1991 prohibits the sale,mortgage,gift or lease of any land acquired by the government under the Land Acquisition Act 1894.

The I-T official has been charged with misusing the letter heads of two MPs and some legislators to post complaints against two women officials of his department

A non-bailable warrant of arrest has been issued against an Income Tax commissioner, presently posted in Kanpur, for a case of forgery.

The I-T commissioner, Bhartendu Pratap Singh, has been charged with misusing the letter heads of two MPs, Zafar Ali Naqvi and Dhananjay Singh, and some legislators to post complaints against two senior women officials of his department.

According to police sources, the MPs denied having made any such complaints and also denied that the letter heads used in the case belonged to them. One of the MLAs, however, admitted that he had given some blank letter heads to one of his associates who

confessed he had passed them on to the I-T official.

The I-T commissioner, incidentally, is the son-inlaw of former Uttar Pradesh chief secretary Akhand Pratap Singh who was booked on charges of corruption by the CBI and even had a stint in jail.

Meanwhile, top police official were evasive when asked about the possibility of the I-T official being arrested.

Around 10 lakh devotees witnessed the Soorasamharam held as part of the Kanda Sashti festival at Tiruchendur in Thoothukudi district on Thursday.

The Kanda Sashti festival, which began on November 6 with the yagasalai puja when lakhs of devotees commenced the six-day sashti viradham, came to an end with the Soorasamharam Thursday evening.

The idol of demon kings Soorapadman, Gajamugasooran and Singamugasooran were taken to the beach in front of Subramaniyaswamy Temple at Tiruchendur around 4 pm.

nathar (Muruga), kept at the Sashti Mandapam, was taken to the spot amidst the crowded devotees around 5.30 pm for the ritual of the battle between the Lord and the demon Kings.

According to myth, Lord Jeyanthinathar killed Gajamugasooran followed by Singamugasooran and Soorapadhman and saved mankind.

The crowd that waited patiently on the beach for about four hours from 1 pm hailed the Lord by shouting “Arohara” and “Vetrivel Veeravel” once the idols of the demon kings were beheaded to symbolise the victory of good over evil.

After the Soorasamharam, the idol of Lord Jeyanthinathar was brought to the Santhoshamandapam, where special pujas were performed. The devotees then took a holy dip and ended the Sashti Virahdam.

With the November 15 deadline looming, as many as 500 government colleges across the state have failed to register for the fee reimbursement scheme. The state government has made mandatory for all the colleges to register online from this year to claim fee reimbursement for their students.

Nearly two lakh students pursuing various courses in junior and degree colleges and ITIs stand to lose the benefit of free education if their colleges don’t register

in time, as the government has made it mandatory for all colleges to register online from this year to claim the fee reimbursement for their students.

Of the 1,200 government junior colleges, nearly 400 process of identifying these colleges and has asked district collectors to initiate criminal proceedings against them and recover the money they have siphoned off by invoking the Revenue Recovery Act.

According to officials, the government colleges might have also failed to register as hundreds of these colleges either had no principals or incharges concerned to take up the job. In some cases, the colleges even had no budget to get the registration done.

Several govern ment colleges that lack computers and Internet connections have failed to register for the fee reimbursement scheme.

“It came to our notice that many government colleges had no computers or Internet connection. In some other colleges there are no principals who can take the responsibility of getting the registration done. We were also told that the colleges had no funds to get the registration done in private Internet centres,” said Mr Raymond Peter, principal secretary, BC welfare department.

Of the total 27 lakh fee reimbursement beneficiaries, nearly 17 lakh fall under BC welfare department alone.

He said lack of awareness on the online registration among the staff in government colleges could have

also contributed to the present situation.

"We will get a clarity on the exact number of colleges which failed to get registered only after November 15. We expect many colleges to get registered till November 15 as there are still three days left for the deadline," Mr Peter said.

Meanwhile, the government lecturers blamed the welfare department officials for the mess. “The entire process was made online without realising that many government colleges had no computers, scanners and Internet connection. They have not bothered to allot money required for the purpose even if we have to opt for private computer centres outside to get the job done. Nearly 100 junior colleges had no principals. There are none to take the responsibility,” said Mr K. Phani Kumar, representative of the government lecturers association.

The government is now in the process of identifying the remaining 1,760 colleges that claimed fee reimbursement last year and failed to register for this year till now.

The government asked the respective district collectors to take steps to identify these colleges and initiate criminal proceeding against the managements apart from recovering the among by invoking Revenue Recovery Act.

Dr Priyamvada Gopal,the dean of Churchill College,said in her complaint to the college how she had to reject the advances of the inebriated student in March 2007,after being caught up in a groups naked rampage through the institution,the Daily Mail reported.
Several very drunk students and alumni after a rugby dinner,some of whom were running naked around college,and one of whom propositioned me, she said in her complaint.
In fact,indecent exposure,vandalism,violence and alcohol-fuelled high jinks are a regular part of the social scene in the college.Since 2005,some 91 incidents involving over 100 students have been recorded at Churchill College,it emerged after a Freedom of Information request.In October 2006,two amorous students were caught indecently exposing themselves in the library.A report states: Two students,one female,were cautioned and told to see the librarian to apologise. CLAIMED TO HAVE TOUCHED SABARIMALA IDOL

The crime branch Nov. 10: The crime branch of Kerala police is planning to chargesheet Kannada film actress Jayamala who stirred up a controversy in 2006 by claiming that she had entered the sanctum sanctorum of the Sabarimala Ayyappa temple in 1987 and touched the idol.

The crime branch, that had been ordered to probe the issue, is now accusing the actress of conspiring with her astrologer, Parappanangadi Unnikrishna Panicker, to malign the famed temple by making a false claim.

It was two weeks after Mr Panicker held a ‘devaprasnam’ (astrological fact-finding) and ‘discovered’ that women had entered the temple that the actress sent a fax message to the Travancore Devaswom Board and divulged to a TV channel that she had touched the idol.

In 1986 Kannada actress Jayamala had reportedly taken a vow that she would visit Sabarimala temple if her husband Prabhakar, a popular actor, recovered from an injury to his hand.

Jayamala claimed she visited the temple with Prabhakar in April 1986. In an interview to a Bengaluru tabloid in May, Jayamala

reportedly claimed she had visited the temple. But her claim that she touched the idol inside the sanctum sanctorum of the temple was made public only in 2006 when Panicker held the ‘devaprasnam’.

The actress then said Panicker had come to her Bengaluru house in 2000 and held an ‘ashta mangala prasnam’ to find out if some lapse was affecting her.

Mr Unnikrishna allegedly told her that she had a ‘sparsha dosha’ (sin after touching a sacred object). The actress reportedly recalled the 1986 incident and Mr Unnikrishna wrote an ‘ashta mangala mantra’ for her.

Jayamala further claimed she had got a call from the Devasam Board in 2006 asking her to fax her claims.

She sent a fax and also accused Mr Unnikrishnan of making her the scapegoat in the issue.

When contacted, she said: “I have nothing to say on this. In 2007, the Kerala police had come to my house and I have cooperated in the investigation. In subsequent years, I have answered all the questions of the Kerala police. If they are filing a chargesheet, I must know what offence have I committed? I will get a copy of it through my advocates before reacting.”

probe finding Crime Branch sleuths have discovered that Mr Panicker, who had scores to settle with the temple priests, had persuaded Jaya mala, one of his clients, to claim that she had entered the temple.

This was to buttress his devaprasnam `find ing' that Lord Ayyap pa was angered by the entry of women.

The Crime Branch has reportedly charged the actress under Sec tion 295 A of IPC for maliciously attempt ing to hurt religious feelings. Mr Panicker is the first accused in the case and his aide, Raghupathy, is the second accused.

Senior advocate and former law minister Shanti Bhushan and his lawyer son Prashant Bhushan on Wednesday turned down the Supreme Court proposal for apology in a contempt case arising out of junior Bhushan’s interview allegedly casting aspersion on Chief Justice of India S.H. Kapadia for hearing Vedanta case a few years ago when he was not the CJI.

As a special bench of Justices Altamas Kabir, Cyriac Joseph and H.L. Dattu said that it at the very beginning of the hearing earlier had proposed the option of apology, which is also a part of contempt proceedings but

Shanti Bhushan outrightly rejected it.

"The question of apology does not arise. Whatever has been said we have repeated it in a detailed reply. I would rather like to go to jail," the former law minister said interject while senior advocate Rajiv Dhawan was arguing on behalf of Tehlka editor Tarun Tejpal, also facing the contempt proceedings for publishing the interview.

In his interview Prashant Bhushan had questioned the presence of Justice Kapadia in a bench that heard Vedanta's Orissa mining case and passed interim order permitting the mining.

Mr Bhushan raised the question of "propriety" as Justice Kapadia allegedly held some shares of the company.

In the contempt proceedings initiated on a reference by amicus curiae Harish Salve, Bhushan and Tejpal were accused of trying to sensationalise the whole issue without any basis and facts on record.

During Wednesday's hearing also Justice Kabir asked Tejpal's counsel as to what is the exact meaning of Tehlka when Dhawan tried to bring home a point that whatever had been stated in the said publication, was done "bona fide" in the public interest not with any ill intention and the publication had a track record of exposing corruption.

Scientists, including British particle physicists, will now study the particles in the hope of discovering what holds atoms together and gives them their mass, reports the Telegraph. The collisions were produced by firing lead ions -atoms with their electrons removed -at incredible speeds in opposite directions around the LHC's underground tunnel at CERN, the European Organization for Nuclear Research, near Geneva. The heavyweight particle colli sions follow seven months of experiments crashing protons, which are 200 times lighter than lead ions, at near-light speeds. "We are thrilled with the achievement. The collisions generated mini Big Bangs and the highest temperatures and densities ever achieved in an experiment," said David Evans, of Birmingham University. "This process took place in a safe environment generating incredibly hot and dense subatomic fireballs with temperatures of over ten trillion degrees," he added. The latest experiment at CERN went ahead despite warnings by a group called Heavy Ion Alert that it could trigger a catastrophic chain reaction that might destroy the earth. LHC scientists dismissed the claims.

New Delhi: Parents are not reliable witnesses in fratricide cases as they invariably turn hostile to save the other child from long incarceration or even gallows,which is the punishment for murder.
The Supreme Court has come to this conclusion after looking into the behaviour of parents,who have witnessed incidents of one of their child killing another,be it over property or other disputes.
It does not blame the parents and,instead,tries to understand the feelings that lead them to turn hostile during the trial or when supporting the accused child.The case in hand related to the murder of one brother by another in a remote village of Tamil Nadu.During the trial the mother turned hostile.Though the attempt by the mother to save her accused son from life imprisonment failed as the apex court upheld the life sentence to one of her son,Ram Gounder,a Bench comprising Justices H S Bedi and R M Lodha understood the psychology behind the mothers decision not to support the prosecution against the accused son to fasten the guilt on him for murdering her other son.
It said,We are not surprised that the mother of the deceased and the appellant,who had been cited as a prosecution witness,had instead appeared in court as defence witness,as this is a common tendency in fratricides,and particularly where parents are involved as witnesses. 
After tempers cool and there is time for reflection,they (parents) find that while one child has been murdered and the other faces the prospect of serving a long sentence on their evidence,which will,without doubt,be believed,and this invariably makes them resile from their police statements, the Bench said.
But,what stood against Ram Gounder despite his mother resiling from her police statement was the unimpeachable medical evidence that clearly pointed towards his guilt in murdering his brother.The Bench dismissed his appeal and upheld the previous life sentence.

Man on diamond diet nabbed

Lankan Smuggled Precious Stones By Concealing Them In Stomach

Chennai: A Sri Lankan who had 2,060 pieces of diamonds and other precious stones lodged in his stomach was arrested from the airport by the central crime branch of the suburban police.The stones,estimated to be worth between Rs 1.5 crore and Rs 3 crore,were recovered.
Addressing a press conference on Wednesday,suburban police commissioner S R Jangid said he received a call on Tuesday morning from a reliable informant that the man was travelling to Chennai on an Air India flight.That was the only information available and no other clue,but we zeroed in on him as soon as he came out of the airport and tried to board a taxi, he said.
The Lankan,identified as Mohamed Rafi (35),who arrived from Colombo on Tuesday morning,had successfully cleared the customs and immigration.A team led by assistant commissioner of police S Jayakumar picked up Rafi who was carrying two hand bags,but the search of the bags proved futile.
Rafi was then confronted by the sleuths but he maintained that he was innocent.He was even warned that he would be subjected to a medical test.The police commissioner said that even during questioning,Rafi could not sit comfortably and when questioned,he told the police that he was suffering from piles.The police,who grew suspicious,took him to the Chromepet Government Hospital.When doctors examined him,they found the stones lodged in his gut.
Displaying the stones,Jangid said Rafi had a valid passport and was acting as a human courier and was paid only Rs 10,000 for the job.He had stored the precious stones in 42 condoms and had swallowed all of them.It took the police six hours to retrieve the stones after they fed him laxatives and bananas.
Rafi is a native of Galle and had done three such runs to Chennai from Colombo in the past but his luck ran out during his fourth attempt.He told the police that he was to book into a lodge in Mannady and that someone was to come over to collect the stones.He told the police that on previous occasions,three persons named Kumar,Rafiq and Sabir had collected the consignments.
V Varadharaju,deputy commissioner of police,said Rafi had confessed to swallowing the stones at 4am on Tuesday before boarding the 6.30am flight from Colombo.He would be handed over to the customs who would probe his international links,police said.

Killing microfinance will help moneylenders

Its actually a boon to moneylenders.For two decades,microfinance institutions (MFIs) have spread fast in Andhra Pradesh,reaching millions of poor women and filling the space once dominated by moneylenders.But last week,the state government issued an ordinance that temporarily shuts down and permanently maims MFIs in the state.This also threatens to maim MFIs across India,since equity investors and bankers will be reluctant to finance a sector with such political risks.
The AP government says it is protecting borrowers from coercive loan recovery by MFIs that reportedly has caused 30 suicides.Its not-so-hidden agenda is to give the governments own microfinance scheme through self help groups (SHGs) a lending monopoly,eliminating MFI rivals.The preamble of the ordinance clearly says that MFIs are a threat to SHGs and must be quashed.
The government is supposed to be a referee.But in AP,the referee is also a big player and it wins by disqualifying rivals.The state alone cannot provide enough inclusive finance,so villagers will be driven back to moneylenders.Money lending thugs posing as MFIs have apparently caused some suicides.
We need a regulatory regime that checks malpractices while encouraging the positive aspects of microfinance.But local politicians dont want to empower people through independent access to finance: they prefer patronage networks that can be used as vote banks.Government-driven SHGs can serve that purpose,but not MFIs.
Of the 30 reported suicides,17 were borrowers from SKS,the biggest MFI.SKS says that none of the 17 was a defaulter or in arrears,so their deaths could not be due to microfinance.The authorities should look at all possible causes.Right now,MFIs have been branded as killers without conclusive evidence.
Many MFI agents have been arrested.Arrests were feared of the most distinguished MFI stalwarts like Vikram Akula of SKS and Vijay Mahajan of Basix,who have for years won national and international awards for their pioneering social work.The high court has fortunately stopped this.
Among millions of borrowers,there will always be some looking for any excuse to default.The ordinance provides them a readymade route.Even complaints of having been insulted or annoyed are,under the ordinance,enough to put MFI officials in jail.
The ordinance halts all MFI operations until they register with district authorities,which MFIs fear will take weeks.The ordinance also forbids any MFI to lend to a member of an SHG without first getting a no-objection certificate.
The MFI model depends critically on the discipline of weekly meetings with borrowers,for loan disbursements and repayments.The ordinance stops all weekly meetings till the rural administration gears itself to register all MFIs,and a delay of weeks can destroy the entire loan discipline.Some politicians will be happy to encourage default (as in loan melas) and kill MFIs.
But that will be an appalling loss for India.A globally acclaimed industry that employs thousands and benefits millions is at risk.New Delhi should intervene to amend the most noxious clauses of the AP ordinance.
Most MFIs started as NGOs,as did Nobel Prize winner Mohammed Yunus.But NGOs had limited reach,being dependent on donor finance.So,many switched to a forprofit model,which enabled them to raise money for expansion from equity investors and banks.Such MFIs expanded hugely,reaching not just thousands but millions.
But success bred problems.Some MFIs expanded at over 100% per year,affecting quality.In some areas,multiple MFIs gave multiple loans to the same womens groups,leading to excessive and unviable debts.Some field agents reportedly used force to recover loans,although managements prohibited this.In some areas,moneylenders posed as MFIs,and used muscle for loan recovery.
Award-winning heads of MFIs are outraged at being treated like criminals and want to sue for defamation.But the political threat can only be met with people power.MFIs should organize thousands of women borrowers to demonstrate in their favour.This will convince the public that MFIs are benefactors,not exploiters.Once politicians and bureaucrats are surrounded by thousands of women demonstrators,their hostility to MFIs will ebb or evaporate.
Organizing women for this will take effort,time,and a radically new training manual.The first step might be to mobilize borrowers for annual awards for the best borrowing group,most successful entrepreneur and demonstrating in support.Later,the same organizational skills can be used to demonstrate against political attacks on MFIs.So,apart from canvassing support from New Delhi and the RBI,MFIs must immediately start harnessing woman power.The question remains whether they will survive long enough to achieve this.

Hollywood stars wed Hindu style in Rajasthan

Ranthambore: Finally,the seasons most talked-about wedding took place here on Saturday evening.Hollywoods guests in the desert state Katy Perry and Russell Brand all decked up in traditional Indian attire,took the pheras.A grand dinner followed as a mark of celebration.
On Saturday morning,two elephants - Mala and Lakshmi - walked into the venue with the red carpet rolled open for their welcome.The Indian Management company,which was to organise the wedding,was replaced at the last moment with a Hollywood-based event management company.
Brand,like a traditional Marwari groom,had sported henna on his hands for the grand event.
According to a guest invited for the rehearsal dinner on Friday,Katys father was keen that all the wedding ceremonies are in line with Indian traditions.In a tent that was decorated in pink and orange hues with marigold,the guests were also dressed in traditional Indian attire.Katy was wearing an orange saree with glass bangles and a bindi and Russell was sporting a maroon sherwani.It was largely a family affair.There was dhol- music and they danced to Bollywood numbers.Even on the menu were kadhi,gatta and bajre ki roti. 
For the entire day on Saturday,no guest moved out of the resort.In the evening as around a couple of hundred mediapersons from across the world waited outside the boundary walls,all that could be seen was the venue being lit up and decorated.The atmosphere between the guards and the media was amicable,flashes that Brands guards had taken away a day earlier,were returned.And together they stood sharing light moments between themselves.

Kerala not to accept advance tax from Bhutan lottery distributors

Kochi: The Kerala government is taking legal steps to ensure that it will not have to collect advance tax from Megha Distributors,the promoters of Bhutan Lotteries,despite the recent order from the High Court,state chief minister V S Achuthanandan has said.
Kerala government will soon promulgate an ordinance to regulate the distribution,sale and conduct of lotteries in the state.This ordinance will have adequate provisions to clean up the lottery sector.Only those lotteries which adhere to the provisions of such laws will be permitted into the state.Megha Distributors was not conducting Bhutan Lotteries in accordance with such laws of the state and central governments, the chief minister said at a press conference here on Monday.
A high level meeting is to be held at Thiruvananthapuram on October 20 to explore various options including filing an appeal against the recent HC order directing the state government to collect advance tax from Megha distributors.
The proposed ordinance will insist that lottery tickets have to printed in responsible government security presses and that the draw of lots should be a transparent process,he said.
The chief minister conceded that there were lapses on the part of the state government in taking actions against the illegal lottery activities in the past.We dont want to wash our hands off by laying the blame on the officials for those lapses.But we are now taking comprehensive steps to curb the illegal lottery elements from operating in the State, he said.
Achuthanandan said the proposed ordinance would be framed in consonance with the central lottery laws.
He however demanded that the central lottery laws must be amended to ensure that the state governments will have the powers to curb the operations illegal lotteries in the states.

Parents raise voice against school mgmt

Chennai: Parents of children studying in Calibre Academy,formerly Mrs YGP School,expressed their dissatisfaction with the school management for failing to get their school affiliated to the Central Board of Secondary Education even five years after the school was started.
They met the director of the school education department on Monday and submitted a letter listing their complaints.The letter said,The school was started in 2005 and has neither procured the no-objection certificate (NOC) from the state required for CBSE affiliation nor a provisional affiliation from the board. 
Madhur Bomb,a parent,said,Before admitting my child,I was told the affiliation would come through by the beginning of the academic year.They also told me that the building would be up by the time classes start.But neither promise was kept.The school has applied for affiliation only on June 30,2010,and the school operates different sections of the school from four campuses,one of which is in a commercial complex. 
Responding to the allegations,the school trustees put up a notice on the school website clarifying that it was not illegal to run a school without an NOC,and that several schools have obtained provisional affiliation without production of the NOC.Head teacher Rama Narayanswamy said,We have applied for a provisional affiliation.We expect to hear from the CBSE around November or December. She said that the government had allotted the land for the school building but hadnt yet handed it over to the management.We expect to move the middle and high school into the new premises by beginning of the next academic year,and the primary section during the first term in the next year, she said.The letter from the parents said,The management repeatedly ill-treats and threatens the parents. Parents also displayed a text message received from the school on September 15 asking students to contribute to a book-donation drive.Send 1 book through your ward tomorrow,positively.Or else your ward will be sent back home, the message reads.
Managing trustee of Calibre Educational Foundation Madhuvanthi Arun personally addressed the concerns of the parents who questioned the school on the affiliation issue last week.The parents were specifically told that they have every right to ask these questions and that this would not affect the students in any way, Rama Narayanswamy said.
The parents also alleged that the school charged high fees and hiked it in the middle of the year.The school management said: The additional fees is being collected to ensure that the payscale (of teachers ) is in line with leading schools across the country,to ensure continually high teaching standards and to ensure low staff turnaround in the interest of the children.

On a high: 45% teens drink excessively

Chennai: Peer pressure,plenty of pocket money,easy access to alcohol and low parental supervision is leading to a rise in drinking among teenagers in Indian cities.One in 10 teenagers binge drink and a third of all teenagers are likely to have their first drink before they go to college,according to a new survey.
Alcohol consumption among teenagers in metros is increasing,with 45% of class XII students drinking excessively,five to six times a month,reveals the survey conducted by the Associated Chambers of Commerce and Industry of India.The study covered more than 2,000 teenagers between the ages of 15 and 19.

Chennai: A third of all teenagers are likely to have their first drink before they go to college.Alcohol consumption among teenagers in metros is increasing,with 45% of class XII students drinking excessively,five to six times a month,reveals a survey.The reasons include peer pressure,plenty of pocket money,easy access to alcohol and low parental supervision.
More than 32% of the teens surveyed said they drink when they are upset,18% said they drink alone,15% said they drink when they are bored,and 46% said they drink to get high,according to the survey conducted by Associated Chambers of Commerce and Industry of India (Assocham).
Students said they spend 3,500 to 4,500 a year on alcohol,more their combined spending on beverages,movie tickets or books.And 45% said their parents do not know where they go in their spare time,and dont impose any restrictions.
Dr SV Srikanteswar,consultant psychiatrist,National Institute of Mental Health and Neuro Sciences,Bangalore,says they have seen a rise in teenage drinking in the past five years.We get six to eight cases a month,of which two or three are girls.Parents dont notice it initially,only when teachers complain about poor grades or there are behavioural changes,do they approach us, he says.
The survey covered more than 2,000 teenagers between the ages of 15 and 19 in major cities,including Mumbai,Goa,Kochi,Chennai,Hyderabad,Indore,Patna,Pune,Delhi,Chandigarh and Dehradun.Conducted from July to September,the study observed that consumption of liquor is higher in Delhi and Mumbai,followed by Chandigarh and Hyderabad.
Dr Shanthi Ranganathan,founder,TTK Hospital,Chennai,which has been running de-addiction programmes since 1980,says they are seeing younger people with alcohol dependency.Earlier,we had people in the 40 to 45 age group.Now we have people under 30 coming to us.We are also seeing more mothers accompanying them;earlier it was mostly wives who came along, she says.Often,when Dr Shanthi and her team trace the case history,they discover that many had their first drink at 16 or 17,usually after the class XII exams to celebrate.
The study findings show that peer pressure is one of the main reasons for early drinking.The data we collected shows that more young Indians are drinking due to peer pressure,easy spending power and access to alcohol, says DS Rawat,secretary-general,Assocham.
Most teenagers view drinking as a fun pastime,one that replaces lack of after-school activities.Teenage boys are more likely than girls to have had a drink.Alcohol use is also greater among older teens than younger ones (46% vs.12%).
Many experts believe alcohol consumption among teens in going up,even in the absence of hardcore scientific data, says Dr Rajat Ray,professor and head,department of psychiatry,All India Institute of Medical Sciences,Delhi.
The survey also indicates that 70% of teens consume alcohol during farewell parties,New Year,Christmas,Valentines Day,birthdays and other occasions.One in 10 binge drink or c o n s u m e five or more drinks at a time.Dr Shanthi says 10% to 15% of those who start drinking at the age of 16 run the risk of becoming addicts.The study says usage of alcohol has resulted in deliberate self-harm,high-risk sexual behaviour,liver disease and duodenal ulcers.Other consequences include academic problems,poor health,mental health problems,accidents and addiction.Talking to your child about responsible drinking could prevent consumption,says the study.In many cases,there is also a history of family problems or addiction, says Dr Srikanteswar.Parents need to keep lines of communication open and educate children about ill-effects of drinking.

Muslim performs Durga puja in Kolkata locality

Kolkata: Shahid Ali is a priest who will perform the rituals at a Durga Puja this year.But thats not the only reason were writing about him.Like the deity he will worship,Shahid and the humble locality he stays in,are a symbol of the victory of good over evil,of humanity over divisive faith and of the secular mind over zealous theocrats.He is also an envoy of the new India one that has moved well beyond the mandir-masjid dispute.
Shahid,though,would argue that his mohalla,at Munsiganj in Kolkatas Kidderpore area,had moved on long ago.When the Babri Masjid was razed and riots broke out in several parts of India,Shahid remembers playing cricket with his Hindu friends,hitting sixes,taking catches and celebrating wins and mourning losses together.
That was 1992.Shahid,now in his early thirties,has seen a couple of decades pass by since.And over those years,the Hindu-Muslim bond grew into kinship.And Shahid,who has been performing Durga Puja for seven years,mastered the Shastras.
A visit to the area shows why.On Wednesday,with Kolkata in Mahasasthi attire,preparations at Five Star club were on at a hectic pace.The 71-yearold puja is organized by Muslims but the scene at Munshiganj is no different from any Hindu locality.
Balwant Singh,a member of the puja committee,says: Shahid fasts for all four days and performs puja according to Hindu Shastras. 
The mohalla does its bit,too.Through the Puja month,Muslims here dont eat beef.Shops dont sell it either.The mood is summed up by 60-year-old Shanti Begum. Ma ashchhen,anondo to hobei (the goddess is coming,its time to celebrate), she says.

SC says unintentional disobedience doesnt amount to contempt

New Delhi: Accidental or unintentional disobedience of court orders does not amount to contempt,unless there is a wilful attempt to obstruct the course of justice,the Supreme Court has ruled.
Accidental or unintentional disobedience is not sufficient to justify one for holding guilty of contempt, a Bench of Justices J M Panchal and Gyan Sudha Mishra held in their judgement.It is further relevant to bear in mind the settled law on the law of contempt that casual or accidental or unintentional acts of disobedience under the circumstances which negate any suggestion of contumacy,would amount to a contempt in theory only and does not render the contemnor liable to punishment, the court said.
The court gave the verdict while quashing the contempt proceedings initiated against Dinesh Kumar Gupta,deputy registrar (judicial),Rajasthan High Court.Gupta had moved the apex court questioning the contempt proceedings initiated against him by the HC on December 8,2006,for an alleged contempt committed by his predecessor in 2001 vis-a-vis an order passed by the judge on March 22,2001.
The HC had initiated contempt against Gupta on the ground that the order for initiating inquiry against Motor Accidents Claims Tribunal judge S K Bansal was sought to be scuttled by the registry.
Justice Sudha said at that period,Gupta was not the deputy registrar (judicial).Besides this,it would also not be correct to overlook or ignore an important statutory ingredient of contempt of a civil nature given out u/s 2(b) of the Contempt of Courts Act,1971,that the disobedience to the order alleging contempt has to satisfy the test that it is a wilful disobedience ... a proceeding for civil contempt would not lie if the order has been disobeyed itself provides scope for reasonable interpretation of an order or circumstances.
