NEW DELHI: Justice PD Dinakaran made a futile attempt to withdraw his resignation a week after submitting it to the President with the law ministry citing a 1978 constitution bench judgment of the Supreme Court to reject the former Sikkim High Court chief justice's request.
Justice Dinakaran had resigned on July 29, rendering infructuous a two-year-old motion in Rajya Sabha for his removal on charges of corruption. He had said that he had lost faith in the impartiality of the committee set up by the Rajya Sabha chairman to inquire into corruption charges against him.
On August 4, Justice Dinakaran had a change of heart and wrote to the law ministry seeking to withdraw his resignation. But the ministry declined to act on the fresh request citing the 1978 judgment.
