If 62 families sitting on a piece of Pallikaranai marshland for about 30 years are to be evicted to protect the water body , similar eviction should be done in the case of at eight other corporates, schools and a central government institute, argued their counsel in the Madras high court on Tuesday .
When the cases filed by these families seeking redrawing of the marshland and allocation of the land they were occupying, with patta and other documents, came up for further hearing before Justice N Kirubakaran on Tuesday , their counsel P Vijendran said the Centre's NIOT and other multistoried buildings standing on the water body too were encroachers and they too should be evicted.
Earlier, special government pleader (forests) M K Subramaniam furnished a map of Pallikaranai marshland to the court, but sought time for furnishing other details.
There is another issue concerning sale deeds and grant of patta for 66.7 acres in the marshland in favour of a trust called Boomi Balaha.Referring to this during the ast hearing, Justice Kiru bakaran had said the marshland was sought to be sold through sale deed by land grabbers using fake documents, claiming that the land belonged to Ettayapuram Zamin.
On October 13, 2004, a sale deed was executed in favour of Boomi Balaha to convey 66.70 acres, but the sale deed was registered in Royapuram sub-registrar office which had no jurisdiction, the judge said.
On Tuesday , Justice Kiru bakaran called upon all departments, including Chennai Corporation, to pay attention to evict encroaches from Pallikaranai marshland and identify the encroachers and spell out measures to evict them. They shall also file a report and FMB sketch by October 6, 2015.
